AGREEMENT OF PUPPY SALE, (SPAY / NEUTER CONTRACT) THIS PUPPY CANNOT BE BRED
It is agreed that the Male - Female - Shiba Inu - puppy, whelped on, _____________ is being sold
for pet/companion purposes only.

~This said puppy is guaranteed to be inoculated with first shots, wormed, and an A.K.C Limited ( No breeding rights) puppy registration application will be mailed to the said puppy buyer(s) at the time that the terms of this spay /neuter agreement have been fulfilled.
~The breeder guarantees this said puppy to be in good health and temperament at the time of sale and will replace said puppy returned within 72 hours (excluding weekends / holidays), providing the puppy is accompanied by a written certificate of ill health from a licensed veterinarian. If a replacement puppy is not available at the time of return of said puppy, full refund of the original purchase price will be given. The breeder has up to 90 days to refund full puppy purchase price. The breeder will NOT be responsible for any debts or expenses incurred by the said puppy buyer(s) for any reason.
~The breeder guarantees that both the Sire and the Dam of said puppy have both been Certified and or Pre-limbed Clear and or Normal by both the O.F.A and C.E.R.F. The breeder will replace said puppy at no cost up to the age of two (2) years if said puppy is deemed by a licensed veterinarian to be afflicted with a genetic defect, Hip Dysplasia or having a luxating Patella greater than a Grade 2, but the breeder has the right to a second opinion before a final decision is made of a replacement puppy guarantee.
~The Parties agree that any dispute arising out of this Contract will be heard by the appropriate Michigan court, the parties agreeing that jurisdiction is properly in Michigan.

ADDITIONAL CONDITIONS OF THE REGAL SHIBAS SPAY/NEUTER CONTRACT - PAGE 2 OF 4
(1.) The said puppy must at all times throughout it's life, be provided with adequate housing from inclement weather, an annual checkup by a licensed veterinarian, required vaccinations, including rabies, and heartworm prevention medication.
(2.) The buyer(s) agrees that if for whatever reason they cannot keep said puppy, breeder must be contacted by phone and certified mail, and said puppy must be returned back to the breeder in good health with no refund to the buyer(s). Buyer(s) will pay all shipping cost of the return of said puppy.
(3.) At NO point and time of said dog's lifetime is the buyer(s) to give, sell, lend, place, lease or co-own said puppy to any other person, company, corporation, breeder, pet store, Animal Broker, wholesale dealer, testing lab, animal shelter, puppy mill etc.
(4.) The said puppy must be spayed /neutered by the age of 7 months. A copy of proof of spay/neuter signed by the performing licensed veterinarian must be supplied to the said puppy's breeder before any A.K.C papers will be released to buyer(s). Failure to provide breeder with proper proof of spay /neuter of said puppy, signed by the performing licensed veterinarian by the age of 7 months will be considered breach of this contract. At that time of breach of this contract, said puppy will be returned to the breeder in good health at no cost to the breeder or there will be a penalty charge FIVE (5) times the original full purchase price of said puppy charged to the buyer(s) and paid to the breeder within 90 days of breach of this contract. Failure of the immediate return of said puppy in good health or full payment of FIVE (5) times the original full purchase price of said puppy paid by the puppy buyer(s) will result in court action at the expense of the buyer(s).
(5.) Buyer(s) agrees to pay any and all shipping costs incurred either upon purchasing the puppy or in the event of forfeiture and return of said puppy. Any puppy shipped by air must be provided with no less than counter to counter quality of service.
(6.) Breeder agrees to microchip said puppy with an AVID Microchip. Buyer(s) will be the main contact and the Breeder will be remain for the life ofsaid puppy as the alternate contact with the AVID database. Buyer(s) agrees to write out a check for $18.50 to AVID to become registered in the AVID database at the time of puppy pick up. Breeder will mail the form and check to AVID immediately following.
(7.) Buyer(s) must also have the licensed veterinarian that performs the spay/neuter of said puppy, scan said puppy for the AVID Microchip number at time of spay/neuter. This veterinarian must fill out and sign microchip questioner on page 4 of 4 of this contract. Buyer(s) must also provide a copy of this questioner to the breeder accompanying signed proof of spay/neuter.
(8.) Said puppy is to ONLY be registered with the A.K.C (American Kennel Club), U.K.C (United Kennel Club) and or C.K.C (Canadian Kennel Club). The registered name of said puppy in any registries will begin with the kennel name "REGAL".
(9.) Buyer(s) failure to comply with any of the conditions on page two (2) of this contract will result in immediate repossession by the breeder of said puppy without refund or compensation of any monies to the buyer(s). If buyer(s) does not immediately return said puppy for breach of the conditions on page two (2) of this contract, there will be a penalty charge FIVE (5) times the original full purchase price of said puppy charged to the buyer(s), paid to the breeder within 90 days of breach of the conditions. Furthermore buyer(s) agrees to pay any and all court costs if this contract is violated and litigated. Any suit will be tried in the breeder's Country, State and County.
(10.) .) If at anytime said puppy dies of natural or un natural causes, breeder is to be immediately notified. Breeder has the right to request proof of an examination and or necropsy by a local/nearby licensed veterinarian office.
(11.) If at any point and time in said puppy's lifetime, said puppy is returned to the breeder for any reason, AKC registration papers must at that time besigned off of ownership by the buyer(s) transferring legal ownership of the said puppy and the AKC registration papers to the breeder.
(12.) Breeder has the right of refusal of this sale of said puppy for any reason at anytime before completion of sale and delivery of said puppy. Full deposit will be immediately refunded and mailed to the said puppy buyer(s) at the time of the breeder's decision, No questions asked.
(13.) It is understood and agreed that the Buyer(s), by signing this contract, has read and understands the provisions of this contract and will abide by it fully. All parties have a signed copy of this contract. Furthermore, this written agreement/contract constitutes all the conditions of the sale and no verbal
statements either before or after the sale will be binding in any way. Failure to comply with all aspects of this contract renders all guarantees null and void.
